The Ministry of Justice has submitted a draft law on strengthening the protection of women’s rights and freedoms, as well as strengthening the institution of family, for public discussion.

It is proposed to completely prohibit the marriage between relatives of the second, third, and fourth degree of kinship (between uncles and aunts and their nephews, as well as between cousins, cousins, and cousins).

  • An exception is made in cases where one of the persons entering into marriage is a adopted child, stepson, or stepdaughter, if the adopted child is not actually a relative of the 1st, 2nd, 3rd, or 4th degree of kinship with the second person entering into marriage.

Also, upon the application of persons wishing to enter into marriage, in cases of pregnancy or childbirth, the district or city hokim at the place of state registration of marriage may reduce the marriageable age by no more than 1 year.

It is proposed to establish that entering into a de facto marital relationship with a person who has not reached marriageable age, if such an act is committed repeatedly after the application of an administrative penalty, will be punishable:

  • a fine of 50 to 100 BCV (20 million 600 thousand to 41 million 200 thousand soums);
  • or compulsory community service from 240 to 300 hours;
  • or correctional labor for up to 2 years.

For comparison: the current legislation for this crime provides for:

  • a fine from 20 to 30 BCV (8 million 240 thousand to 12 million 360 thousand soums);
  • or compulsory public works up to 240 hours;
  • or correctional labor for up to 1 year.
