A man who shows his genitals to girls and offers them intimate relations can be tried under a criminal article

The court sent the case for review after parents involved the media, the Children's Ombudsman, and filed an appeal.

In Tashkent, the case of a man who showed his genitals to minor girls, as well as suggested having intimate relations with him, has been returned and can still be reclassified as criminal, reports the NeMolchi.uz project.

This decision was made after the first hearing of the appellate court, during which it was revealed that the victims’ relatives had no opportunity to examine the case materials, except for an examination conducted against the perpetrator. The court allocated two days for his investigation.

In addition, the girls’ relatives appealed to the Children’s Ombudsman’s office with a request to involve them in the court hearing. Media representatives were also involved in it. During the hearing itself, the girls’ relatives and the Ombudsman’s representative noted that the investigation was incomplete, the girls’ testimony was not taken into account, and the entire investigation was based solely on the offender’s testimony.

As a result, after hearing the parties and examining all the presented arguments, the Tashkent City Court ruled to return the case for further investigation and consideration of the issue of initiating a criminal case against the man. Earlier, the court did not reclassify the case and found the man guilty under Article 183 of Administrative Offenses (petty hooliganism) and sentenced him to 15 days of arrest.

The reason the case was not classified as criminal, according to the investigation, was the conclusion of a medical examination, according to which the man was diagnosed with a disease of the genitourinary system, due to which “his hands are often in pants.” Law enforcement also stated that the behavior was not intentional.

The girls’ parents said that no one believed their children. A resident of a neighboring house, who saw a man demonstrate his genitals to preschool girls at a playground, also wanted to testify and reported it to the district police officer, but no one interrogated her.

So, any adult man can offer indecency to children, and then say he didn’t say such things, and they’ll believe him, not the children? He was punished only because he took off his pants and violated public order. We are indignant with such an investigation and will appeal the court’s decision, — said one of the relatives of the injured girls.

It was reported that the man did not admit his guilt, did not repent of his actions, and did not apologize to the victims. Moreover, before the court hearing, he blamed the mother of one of the girls for writing a complaint against him.

Instead of apologising, he pressed on pity, remembering that he had minor children and chronic illnesses, and not forgetting to mention that he was an exemplary family man, — the victims reported.

The project stated that they would closely monitor the situation and expressed hope that the perpetrator would be held accountable in full accordance with the law, and the victims would receive proper protection.

But it’s unclear why for justice to prevail, the parents of the victims, who themselves are injured, must desperately fight and “chew” their children’s defense? Why are the words of a grown man committing immoral acts more valuable than the words of two little girls walking near the house?

Why is the system, which proclaims the best interests of the child as a priority, not ready to take the child seriously without the complaints of parents, the Children’s Ombudsman, and journalists? — asked the NeMolchi.uz project.

Earlier, it was reported that a man in Tashkent harassed a minor girl in an elevator. The criminal was given five days of arrest.
